Conformity assessment procedure according to Directive 2004/22/EC or 2014/32/EU and national verification law

On October 30, 2006, regulations of the European Directive 2004/22/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of March 31, 2004 on measuring instruments (MID) came into force.

Since 01.04.2016, the EU Directive 2014/32/EU has replaced the old Directive 2004/22/EC. This new EU directive contains clarifications and additions as well as harmonized terminology. As a result, European conformity assessment, e.g. in the form of type examination certificates, is mandatory for certain types of measuring instruments.

The conformity assessment of a measuring instrument by so-called notified bodies replaces the former initial verification. The basic requirements for measuring instruments have not changed. According to the will of the German legislator, from 2015 also nationally approved devices have to be placed on the market according to the same criteria as it is mandatory for European conformity assessed measuring devices.

In implementation of European law, a new Measurement and Verification Act (MessEG) and a new Measurement and Verification Ordinance (MessEV) were drawn up and came into force on 01.01.2015. The manufacturer then confirms the conformity of the measuring instrument manufactured by him with the assistance of a notified body selected by him by means of a declaration of conformity.

The Rule Determination Committee (REA), which has its office and is chaired by PTB, determines rules, findings and technical specifications for measuring instruments, for conformity assessment procedures and for persons using measuring instruments or measured values on the basis of the state of the art, in accordance with Section 46 of the Metrology and Verification Act. The members of the committee are the Physikalisch-Technische Bundesanstalt, the competent authorities of the Länder, conformity assessment bodies, state-recognized testing bodies, trade associations and consumer associations.
